Unfortunately, the way I do it is convoluted as DKC formats sprite data in such a way that they can optimally transfer the data with dma calls. if I recall correctly, mixing and matching 8x8s and 16x16s gets really boggling! My theory: It's a leftover of an earlier design.

That particular flag is a sprite, unlike all other Jolly Rogers in the game which are on the background layer. For this reason, it was likely overlooked when the rest of them were updated to use the final Kroc and Krossbones (Jolly Krocker?) design.

Disabling the checks will indeed enable the tracks, which is what the Pro Action Replay(PAR) codes do in the linked TCRF article. However, it's not quite as simple as that. The changes result in some undesired side effects, one of which is also mentioned in the article.

Do you mean the German v1.1 of DKC2? DKC2 has no v1.2. The versions released in Germany with English and German language options are 1.0 (CRC32 checksum 4C794A4D) and 1.1 (CRC32: 2EB33785), and the rest of Europe received only v1.1 with English and French language options (CRC32: 2EA6B7E8).

The backgrounds often use separate palettes stored in the ROM, but the tinted sprite palettes are nearly always created by copying a large chunk of the sprite palette data into RAM, ANDing each of the color channels to get them separated, and performing various arithmetic operations on each of them....
